Monthly Marketing Services

This includes services such as SEO, Google Ads management, social media management, social media advertising, email marketing, and related digital marketing services.

Payment Terms

Payment is due in full before the beginning of each billing cycle. By engaging Jewelry Medias for recurring monthly services, the client authorizes automatic billing to the payment method provided unless otherwise agreed in writing.

Services automatically renew on a month-to-month basis unless canceled in writing before the next billing cycle begins.

Cancellation Policy

Clients may cancel services at any time by submitting written notice to [email protected]. Cancellation requests apply to the next unpaid billing cycle.

No partial refunds or prorated refunds will be issued once a billing cycle has begun and work, campaign management, monitoring, optimization, reporting, or related services have commenced.

Chargebacks

Initiating a chargeback or payment dispute for completed or active services without first contacting Jewelry Medias to attempt resolution may be considered a breach of this agreement.

Website Hosting Services

Payment Terms

Website hosting services are billed yearly and must be paid in full in advance unless otherwise agreed in writing.

Cancellation Policy

Hosting services may be canceled at any time in writing. Cancellation will apply to the next unpaid renewal term.

No refunds or prorated refunds will be issued for unused hosting time once a hosting term has begun.

Hosting Responsibility

Jewelry Medias makes reasonable efforts to maintain reliable and secure hosting environments, including routine backups based on the client’s hosting plan tier.

Backup frequency currently includes:

  • Monthly backups for Basic hosting plans
  • Weekly backups for Standard hosting plans
  • Daily backups for Advanced hosting plans

While Jewelry Medias takes reasonable precautions to protect hosted websites and maintain service reliability, uninterrupted uptime, complete immunity from outages, third-party failures, cyberattacks, software conflicts, data corruption, or other technical issues cannot be guaranteed.

Clients are encouraged to maintain independent copies of especially critical business data where appropriate.

Third-Party Costs

Domain registration fees, premium plugins, paid APIs, software licenses, external email services, and other third-party costs are separate unless otherwise stated in writing.

Website Design & Development Services

Payment Terms

A non-refundable deposit of 50% is required before work begins unless otherwise agreed in writing. Remaining balances are due upon project completion or launch.

Cancellation Policy

If a project is canceled after work has commenced, all payments made are non-refundable. The client is also responsible for payment for all completed work, hours, revisions, consulting, or development performed beyond the amount already paid.

Delays & Abandonment

Projects delayed by the client for more than 60 consecutive days may be considered abandoned or paused at Jewelry Medias’ discretion. Additional fees, revised timelines, or updated project scopes may apply before work resumes.

Revisions & Scope Changes

Quoted pricing includes only the scope of work agreed upon at the start of the project. Additional revisions, functionality requests, integrations, content population, design changes, or requests outside the original agreed scope may result in additional charges.

Ownership & Transfer

Website files, source code, graphics, designs, and related assets remain the property of Jewelry Medias until all outstanding balances have been paid in full.

Upon final payment, ownership of completed deliverables created specifically for the client will transfer to the client unless otherwise stated in writing.

Third-party software, plugins, themes, APIs, fonts, stock assets, and licensed materials remain subject to their respective licenses and terms.

Accessibility Statement & Limitation of Liability

Jewelry Medias is a digital marketing and web services agency – not an ADA compliance firm, accessibility auditor, or legal authority on digital accessibility. We do not hold ourselves out as experts in ADA law, WCAG standards, or assistive technology, and nothing in our services should be interpreted as legal or compliance advice. That said, we make reasonable good-faith efforts to consider accessibility during the design and development of websites and web applications where reasonably practical.

Formal accessibility compliance work, including efforts related to WCAG 2.1 or WCAG 2.2 standards, ADA considerations, audits, remediation, or accessibility consulting, is only performed when specifically requested and agreed to in writing, and may involve additional fees. Even then, this work is performed on a best-effort basis and does not constitute a guarantee of legal compliance.

Because accessibility standards, interpretations, assistive technologies, browser behavior, third-party software, and legal expectations continue to evolve, Jewelry Medias does not guarantee that any website, application, or digital property will meet every accessibility standard, interpretation, or legal requirement.

Certain content, features, third-party integrations, plugins, widgets, APIs, embedded tools, media, or externally controlled systems may not be fully accessible or capable of being modified by Jewelry Medias.

Clients are responsible for reviewing and approving website content, structure, workflows, and accessibility requirements before launch. Clients seeking formal ADA compliance verification must independently engage qualified accessibility specialists and legal counsel — this is not a service Jewelry Medias provides. Jewelry Medias strongly recommends obtaining independent legal advice regarding ADA and digital accessibility obligations applicable to your specific business.

To the maximum extent permitted by law, Jewelry Medias shall have no liability whatsoever for any claims, damages, fines, penalties, or losses arising from accessibility-related matters, ADA compliance, WCAG standards, or any assertion that a website or digital property is not accessible. Jewelry Medias does not provide ADA compliance services, makes no warranties regarding accessibility, and no refunds, credits, or compensation of any kind shall be issued in connection with any accessibility-related claim. Clients acknowledge that accessibility compliance is solely their own responsibility and that engaging Jewelry Medias for any service does not create any obligation, express or implied, related to ADA or accessibility compliance.

Client Responsibilities

Clients are responsible for:

  • Providing accurate content, credentials, approvals, and materials necessary for project completion.
  • Maintaining proper licensing rights for all text, images, videos, trademarks, fonts, and other supplied materials.
  • Reviewing deliverables and reporting issues in a timely manner.
  • Ensuring that all materials provided to Jewelry Medias do not infringe on third-party intellectual property rights.

General Terms

Third-Party Services

Jewelry Medias is not responsible for outages, policy changes, suspensions, API limitations, billing changes, algorithm updates, or functionality changes caused by third-party providers including but not limited to Google, Meta, WordPress plugins, hosting providers, CRMs, payment processors, social media platforms, registrars, or software vendors.

Suspension for Nonpayment

Jewelry Medias reserves the right to suspend services, websites, hosting, campaigns, maintenance, or support for overdue accounts.

Force Majeure

Jewelry Medias shall not be held liable for delays or failure to perform resulting from causes beyond reasonable control, including natural disasters, outages, cyberattacks, labor disruptions, government actions, internet failures, or third-party service interruptions.

Governing Law

These terms shall be governed by and interpreted under the laws of the State of Texas, without regard to conflict of law principles.

Dispute Resolution

Any dispute arising from services provided by Jewelry Medias shall first be attempted to be resolved informally in good faith. If resolution cannot be reached, disputes shall be handled exclusively in the state or federal courts located in Texas.

Modifications

Jewelry Medias reserves the right to modify these Terms of Service at any time. Updated versions will be posted on this page with a revised effective date.

By engaging Jewelry Medias for services, the client acknowledges and agrees to these Terms of Service.
